Our client entered into an agreement for lease with a proposed tenant of a restaurant, located in one of the most sought after areas on the South Coast.

The tenant repeatedly breached her obligations under the agreement for lease, and after giving the tenant the requisite warnings we advised our client to take possession of the property. The tenant issued a High Court claim against our client for over £5,000,000  for wrongful forfeiture and loss of profit plus costs and interest.

Solution

We advised the client that the claim would have to be defended. We worked with our client closely from the issue of the claim to the trial itself, navigating our client through the pitfalls of commercial litigation, and attending pre-trial hearings at the High Court in the build up to the trial.

Outcome

At a 4 day High Court Trial we successfully had the claim dismissed, and our client was awarded a large proportion of their costs to be paid by the tenant.
